KNOW THE NEW REAL ESTATE COMMISSION RULES

(effective August 17, 2024)

Thanks to the National Association of Realtors® (NAR) settlement, buyers and sellers now have more options to lower real estate agent fees.

Buyers

  1. Most sellers will still offer money to cover or subsidize the fee for your agent, but you will be on the hook if they don’t. 
  2. You must have an agreement in place with your buyer’s agent before you start seeing homes.
  3. The agreement with your buyer’s agent must identify a fixed fee for those services.   (The agent is not supposed to take more than that even if the seller or listing agent is offering more.)

Recommendation:   work with a flat fee broker like us!   Our base rates are $10K or $15K depending on your needs, and if the seller is offering more, we’ll help get that money back to YOU!    We are local, very experienced in this arena, and we get deals done right.

Sellers

  1. While it is recommended you still offer a cooperating commission or a seller concession (see next point) to smooth the way for the buyer, you should no longer be pressured to offer an exact 2.8% like too many were in the past.
  2. Your dollars to help the buyer do NOT have to go to your listing agent first as part of their total commission!   You can get money directly to the buyer via a seller concession.    (This is easier to understand, may have tax benefits to you, and often results in lower total commission paid.)
  3. The final dollars to help the buyer can be negotiated on every deal, and should make their way into any purchase contract.

Recommendation:  work with a flat fee broker like us!    You pay us directly and only for our sell side services.   YOU decide if and how to help the buyer.
